A French court has ruled that TotalEnergies must address climate risks arising from the downstream use of its products by customers — extending the duty of vigilance beyond the company's own operations, subsidiaries, and suppliers. TotalEnergies has announced it will appeal, arguing that the duty of vigilance law was not intended to cover clients' independent choices and that climate change as a global phenomenon falls outside its scope.
The case is a significant test of whether corporate climate obligations can be extended to Scope 3 downstream emissions — those generated by customers' independent use of a company's products — over which the company has no direct operational control.
